First of all, the settlement is jointly owned by you and Maxin according to the rules you put up for Pexdar. Has he even been consulted in this?
And secondly, in your rules there is nothing stating you may alter player property in your town at any notice. Therefore we default to server rules on this. Since it sounds like you will be effectively evicting the settlement's members in order to do this, you must give at least two weeks' notice before commencing any sort of rejuvenation, altering or dismantling of property in the town that isn't your own.

Notice at the centre of town has been given and I've consulted maxin on this already, progress will not begin until I get a final answer from him though....

Yes they will. I check the rules based on the settlement. If the settlement has rules for such an incident, we follow those. If the settlement does not have a rule for a specific occurrence, we will default to server rules and proceed from there.

And once the settlement has followed the default rules on an incident may they change the rules after the incident to adjust to their needs?

Yes, so long as the residents of that settlement are informed of this. After all, to live in that settlement it means they are agreeing to that settlement's rules. They must therefore be kept fully informed of said rules.
